2. Scope

This policy applies to personal information collected through tryavinty.com, checkout, customer service, email, and other channels we operate. It does not apply to third-party websites or services that we do not control, even if they are linked from our site.

3. Information we collect

3.1 Information you provide

  • Name, billing address, shipping address, email address, and phone number
  • Order details, product selections, size, color, and gift or checkout notes
  • Account information, if you create an account (email, password, order history, saved addresses)
  • Messages you send to support, returns requests, and other correspondence
  • Marketing preferences (for example, newsletter opt-in or opt-out)

3.2 Payment information

Payments are processed by independent payment providers. We do not store full card numbers, CVV codes, or bank account details on our own servers.

Depending on how you check out, payment data may be processed by one or more of the following:

  • Shopify and Shopify Payments
  • Shop Pay
  • PayPal
  • Apple Pay
  • Google Pay
  • Card networks (Visa, Mastercard, American Express, and others)

Those providers collect and process payment credentials under their own terms and privacy policies. We receive limited payment-related information needed to fulfill the order, such as payment status, last four digits of a card, card brand, transaction ID, and billing address.

3.3 Information collected automatically

  • IP address, browser type, device type, operating system, and language settings
  • Pages viewed, referring URL, time on site, clicks, and checkout events
  • Approximate location derived from IP address
  • Cookie and similar identifiers (see Section 8)

3.4 Information from service providers

We may receive information from Shopify, payment processors, shipping carriers, fraud-prevention tools, and customer-support platforms — for example shipment tracking, chargeback data, or fraud-risk signals.

4. How we use personal information

We use personal information to:

  • Process, fulfill, ship, and provide updates on orders
  • Process payments and prevent fraud, abuse, and unauthorized transactions
  • Provide customer support, handle returns, refunds, and exchanges
  • Create and manage accounts
  • Send transactional emails (order confirmation, shipping, return status)
  • Send marketing emails if you opted in; you can unsubscribe at any time
  • Improve the website, products, checkout, and customer experience
  • Analyze traffic and performance
  • Comply with law, tax, accounting, chargeback, and card-network rules
  • Protect our rights, customers, and payment partners

We do not sell personal information for money. We do not use your payment card data for marketing.

5. Legal bases (EEA / UK / Switzerland)

If you are in the European Economic Area, United Kingdom, or Switzerland, we process personal information on these bases:

  • Contract: to take steps at your request and to fulfill an order
  • Legitimate interests: fraud prevention, site security, service improvement, limited direct marketing where allowed
  • Consent: newsletters, non-essential cookies, and certain analytics or ads, where required
  • Legal obligation: tax, accounting, consumer-law, and financial-crime requirements

6. How we share information

We share personal information only as needed to run the store and complete transactions:

  • Shopify: ecommerce platform, checkout, hosting, and store operations
  • Payment processors and wallets: Shopify Payments, Shop Pay, PayPal, Apple Pay, Google Pay, and card networks
  • Shipping and logistics partners: to deliver orders and handle returns
  • Customer support and email tools: to answer tickets and send service messages
  • Fraud, security, and analytics providers: to protect checkout and understand site use
  • Professional advisers: lawyers, accountants, or banks when reasonably required
  • Authorities: when required by law, legal process, card-network rules, or to protect rights and safety

Service providers are allowed to use personal information only to perform services for us or as required by law. We do not sell customer lists to unrelated third parties.

If MARKA LLC is involved in a merger, acquisition, financing, or sale of assets, personal information may be transferred as part of that transaction, subject to this policy or a successor policy.

7. International transfers

MARKA LLC is based in the United States and uses service providers that may process data in the United States and other countries. If you buy from outside the U.S., your information will be transferred to and processed in the United States and other jurisdictions that may not provide the same legal protections as your home country.

Where required, we use appropriate safeguards for such transfers, including standard contractual clauses or the transfer mechanisms used by our processors (including Shopify and payment partners).

8. Cookies and tracking

We use cookies, pixels, and similar technologies to:

  • Keep you logged in and remember cart contents
  • Complete checkout securely
  • Remember preferences
  • Measure site performance
  • Prevent fraud
  • Understand how visitors use the store

Essential cookies are required for the site and checkout to function. Analytics, marketing, and preference cookies may be used where permitted. You can control cookies in your browser settings. Blocking certain cookies may prevent checkout or account features from working.

Shopify and payment partners may also set cookies necessary to process payment and reduce fraud.

9. Retention

We keep personal information only as long as needed for the purposes above, including:

  • Order, payment, shipping, and return records for as long as required by tax, accounting, consumer, and card-network rules (typically several years)
  • Support correspondence for a reasonable period after the issue is closed
  • Marketing lists until you unsubscribe or we delete inactive contacts
  • Security and fraud logs for a limited period

When information is no longer needed, we delete or anonymize it where feasible.

10. Security

We use administrative, technical, and organizational measures appropriate to the nature of the data, including HTTPS, access controls, and processing payments through PCI-DSS compliant providers. No method of transmission or storage is 100% secure. You are responsible for keeping account passwords confidential.

We will never ask you by email to send a full card number, CVV, or password.

11. Your rights

Depending on where you live, you may have the right to:

  • Access the personal information we hold about you
  • Correct inaccurate information
  • Delete information, subject to legal retention duties
  • Object to or restrict certain processing
  • Withdraw consent where processing is based on consent
  • Data portability
  • Opt out of marketing emails
  • Lodge a complaint with a supervisory authority

To exercise these rights, email support@tryavinty.com with the subject line “Privacy Request.” We may need to verify your identity before fulfilling the request.

Marketing emails include an unsubscribe link. Transactional messages about orders, shipping, and returns will still be sent as needed to complete the purchase.

California residents

If you are a California resident, you may have additional rights under the CCPA/CPRA, including the right to know, delete, correct, and opt out of “sale” or “sharing” of personal information as those terms are defined by California law. We do not sell personal information for money. Some advertising or analytics cookies may be treated as “sharing” under California law. To make a request, email support@tryavinty.com. We will not discriminate against you for exercising your rights.

EEA / UK residents

You may also contact your local data protection authority. If we appoint an EU or UK representative, we will publish those details here.

12. Children

Our store is intended for adults and for purchases made by parents or legal guardians. We do not knowingly collect personal information from children under 16. If you believe a child has provided personal information, contact support@tryavinty.com and we will delete it.

13. Automated decision-making and fraud checks

Payment processors and fraud tools may use automated checks to approve or decline transactions and to flag unusual activity. A declined payment does not automatically mean you cannot buy from us another way; contact support if you believe a legitimate order was blocked.

14. Third-party links

Our site may link to third-party sites, wallets, or apps. Their privacy practices are governed by their own policies. We are not responsible for those practices.

15. Do Not Track

Some browsers send a “Do Not Track” signal. There is no common industry standard for responding to it. We treat cookie and advertising preferences as described in this policy and in any cookie banner we display.

16. Changes to this policy

We may update this Privacy Policy from time to time. The “Last updated” date will change when we do. The updated policy applies from the date it is posted. Material changes may also be notified by email or a notice on the website.
